BANNING: Border Patrol agent charged with molesting woman
A U.S. Border Patrol agent was arrested Thursday morning on suspicion of molesting a Mexican national whom he stopped and interrogated as she was walking down a Banning street.
Arturo H. Ascencio, 39, of Hemet, was arrested by Banning police and the Riverside County Sexual Assault Felony Enforcement Team at his home about 11 a.m.
Felony charges of kidnapping and sexual battery were filed Wednesday by the Riverside County district attorney's office.
In August 2008, Ascencio stopped a woman who was walking along Florida Street near a child care center, according to a sworn affidavit in support of an arrest warrant.
The woman told authorities he showed her a badge and asked her if she recognized pictures of a "drugged out" woman. When she said no, he told her to get in his pickup, which she did out of intimidation, the affidavit states.
Inside the pickup, she said she saw a pistol, Ascencio drove her to a church parking lot, where he asked her to roll up her pant legs to look for tattoos, the affidavit said.
She said he grabbed her breasts and told her to pull down her shirt. He then let her go, the affidavit states.
The woman, who is in the United States on a temporary visa, was able to identify Ascencio through a photo lineup.
The woman's name and age were not released.
Ascencio was booked Thursday at Robert Presley Detention Center in Riverside, where bail was set at $100,000.
The Border Patrol suspended Ascencio indefinitely without pay, pending the outcome of the criminal charges, said Adrian Corona, supervisory Border Patrol agent with the El Centro sector that patrols the Coachella Valley and Imperial County.
"Like anyone else in law enforcement, we're held to a higher standard," Corona said. "The same laws apply to us and we'll cooperate to see what the facts are."
POLICE SUSPICIOUS
Banning police began investigating Ascencio after witnessing him make a traffic stop that was considered suspicious in August 2009.
A Banning officer spotted a white Ford pickup with lights and sirens pull over a woman in a Ford Expedition. Ascencio was wearing a T-shirt and baseball cap, with no weapon or badge, which police said is not typical for making a traffic stop.
The officer suspected Ascencio might be impersonating a police officer, but when he traced the license plate, it showed the vehicle belonged to a Border Patrol agent.
Ascencio let the woman go and told the Banning officer he pulled her over because the SUV may have been used in smuggling, according to the affidavit.
The situation struck a chord with another Banning officer, who recalled a report from a year ago from a woman who said she was intimidated by a man claiming to be a law officer, Police Chief Leonard Purvis said.
Police tracked down that woman a month later, which is when she told them that Ascencio had molested her in August 2008.
She told them that before he let her go, he asked for her phone number. He called her several times in the following weeks, identifying himself as an immigration agent, and asked her to cooperate with an investigation.
He eventually asked her to meet him. The woman's daughter suggested they meet at the Banning police station, the affidavit states. He didn't show up.
While she was outside the station, she spoke to a police officer about the person she was waiting for, but did not mention anything about being sexually assaulted.
COMMUNITY ANGER
News of the case drew ire Thursday from some members of the Banning community.
Al Lopez, director of the San Gorgonio Hispanic Chamber of Commerce, said the incident showed discrimination and racial profiling by officers preying on immigrants.
"They feel they can take it in their own hands and do what they want to," Lopez said. "They have no limits. They have to respect the law, do things different. There are certain steps everyone has to take."
Border Patrol officials said allegations against one agent shouldn't reflect on the entire department.
"We have the highest integrity to do our job and can't let one agent be what's thought of the Border Patrol," Corona said. "The majority of our workforce are very hard-working and dedicated to the law."

Several things here...

Since when did LEOs have police lights and sirens mounted on personal vehicles? That is a violation of the law right there, and the Banning stooges didn't at least issue a citation or make an arrest for a personal vehicle decked out like that along with the driver making plain clothed, off duty stops?

The Banning Police Department, in my estimation, is the place where reject cops get hired when they can't buy a job anywhere else. The last stop before living in one's car.

This could have happened. Border Patrol agents are LEO's, and I read all the time about LEOs who are child molesters, armed robbers, murderers, involved in the drug trade and a whole host of other crimes. Hardly a week goes by without a newspaper article about a cop who's been arrested and facing the prospect of doing time.

It does seem like the guy was up to something. However, the woman may have added a false fondling allegation for good measure to get back at a jerk.

Then Banning race obsessionist Al Lopez (director of the San Gorgonio Hispanic Chamber of Commerce) spins an allegation of a budding, opportunistic LEO sexual predator into a broad racial issue and carries on as though Arturo H. Ascencio's activities define Border Patrol Policies.

Bizzarre all the around.

LEO's never disappoint me... I hear about one of these miscreants about once a week.

Second time in two weeks in San Bernardino County, kids learning to be cops...

The hometown of San Bernardino County sheriff Anthony Benjamin in Beaumont (Riverside County) is about 12 - 15 miles from both the hometowns of San Bernardino sheriff Nathan James Gastineau, of Redlands (San Bernardino County) and Border Patrol agent Arturo H. Ascencio, 39, of Hemet (Riverside County).

Beaumont is literally next door to Banning, in Riverside county Ca.

All three LEO's are accused of sex crimes committed under color of authority.

It was the second time in two weeks that a San Bernardino County deputy has been accused of having sex with an underage Explorer Scout who was on a ride-along. The incidents involve different deputies and different teens.

Deputy Anthony Benjamin, 30, of Beaumont, was arrested Wednesday on suspicion of oral copulation with a person under 18 and sex with a foreign object with a person under 18, Hoops said at a news conference Thursday. The girl is 17.

On April 22, Deputy Nathan James Gastineau, 30, of Redlands, was arrested on suspicion of committing a lewd act with a minor, a 16-year-old girl. He is scheduled to be arraigned June 27 in San Bernardino Superior Court.

Hoops would not provide any further details of the incidents.

Benjamin, who has been with the department five years, was assigned to the Victorville station. Gastineau, who has worked with department 10 years, works at the Highland station where he supervises that station's Explorers program. Both deputies are on paid administrative leave.

"As the sheriff of San Bernardino County and a parent myself, this is very disheartening," Hoops said. "I'm alarmed."

Hoops said the department will examine all aspects of the Explorer program, including training, evaluation and selection of the deputies who supervise the Explorers. A district attorney's investigator familiar with sex crimes and crimes against children will assist, Hoops said.

"We're going through our Explorer policy with a fine-tooth comb to see if there is anything we need to change to prevent this from happening again," the sheriff said. "I felt that we had everything in place."

Benjamin was arrested hours after investigators in the Victorville office received an anonymous tip that a deputy there might have had inappropriate sexual contact with an underage female, Hoops said.

Benjamin posted $100,000 bail Thursday morning and was released. He could not be located for comment.

Popular PROGRAM

The sheriff's Explorer Scout program provides youths ages 14-21 who are interested in law-enforcement careers a chance to experience police work. There are 245 young people in the Sheriff's Department program.

Lt. Todd Paterson, who supervises the Emergency Operations Volunteer Forces Division, said potential Explorers attend three orientations and meet with advisers before signing up at one of the department's 15 stations. They then go through interviews before being accepted.

Explorers attend a two-week academy where they learn police procedures, firearms instruction and defensive techniques. They assist deputies at community events, do clerical work and direct traffic, among other duties.

After completing the academy, Explorers are then eligible to ride along with deputies on patrol. There, they learn police procedures, including how officers communicate by radio, handle particular situations and talk with the public, Paterson said.

Explorers generally do not stay out on patrol past 10 p.m., Paterson said.

Hoops said he still believes in the value of the Explorer program and that the safety of the youths is a priority.

"We have many fine deputies at all of our stations, who have been involved in Explorers for many years," he said.

What do you guess that in all the crimes that this rat commited, not once was the English language spoken? Not only that, but let's guess that the investigation itself was not done in the English language.

While we're guessing, lets guess that a large number of Border Patrol officers are hired because they understand the culture, the language, and have a very good idea who is probably illegal and who is not.

So, we have a deviant who got hired on with the Border Patrol and, whether he does the job he was hired to do or not when in uniform, attempts to take criminal advantage of people who might not talk out of fear of deportation or other trouble.

How much different is that than the Highway Patrolman on the I-15 desert corridor who pulled over attractive women driving alone with a proposition to "forget" about writing a hefty ticket in exchange for various sex acts performed on himself?

Oh, the Highway Patrolman was on duty.

Coerced sex is rape.

And that Highway Patrolman probably didn't speak a word of Spanish.
