Default John A Perez; California's Next Speaker Of The House

I don't see that this is making big news as far as ripple effects, so I thought I'd point out a few things here in regards to the choice. Here is what you will be getting as far as the next person who gets to have a powerful vote in bringing bills to the floor or holding them back. The speaker also gets to:

"The Speaker of the Assembly presides over the Assembly in the chief leadership position, controlling the flow of legislation and committee assignments."

Assemblymember John A. Pérez was elected to represent the 46th District in Los Angeles.

Growing up in the working class communities of El Sereno and Highland Park, John’s parents taught him the value of hard work and community service. With over 15 years working within the labor movement, John has channeled these values into fighting to create jobs, expand healthcare and protect workers’ rights.

Knowing that opportunity and a path to success are not always easy to find, John has worked tirelessly to create jobs for local residents. He helped lead the effort to mandate a local hire agreement requiring 30% of all major construction jobs to be dedicated to local residents and those in need, providing those individuals with valuable experience and training in skilled professions. He also played a leading role in the increase of the California minimum wage.

Having worked both in housing projects and with immigrants on job sites to improve wages, healthcare and benefits, John also has a deep understanding of the daily struggles that so many working families endure just to survive. John helped organize tenants to learn about lead exposure and abatement programs, implemented free lead screening tests, and instituted education efforts for residents in developments impacted by lead exposure.

John’s work on behalf of the community has been recognized by various elected officials and organizations. Three mayors, including Mayor Antonio Villaraigosa, have appointed John to major Los Angeles City Commissions. Former Assembly Speaker Bob Hertzberg appointed John to serve on a Blue Ribbon panel studying state initiative reform. John also received a Presidential appointment to serve on the President’s Advisory Council on HIV and AIDS.

In addition to his work in the labor movement, John serves as an elected member of the Democratic National Committee. John has served as a board member for the California League of Conservation Voters, AIDS Project Los Angeles, the Latino Coalition against AIDS, the California Center for Regional Leadership, and the Los Angeles Economic Development Corporation.

And also, he supposedly is the first openly gay speaker of the house.

AS PASSED BY THE ASSEMBLY , this bill was substantially similar
to the version approved by the Senate.

FISCAL EFFECT : According to the Assembly Appropriations
Committee, there are no significant costs associated with this
legislation.

COMMENTS : This bill, as amended in the Senate, is non-fiscal,
requires the application for registration of a natural person as
a professional photocopier to be certified to be true, and
includes civil penalties.

Here's a real deceptive piece of garbage from the same guy:

The plan here is to associate the bill with check cashing ID's but it also makes changes in the California ID car. It reduces the penalties at the courts choice, whare as before it had a required 1,000.00 fine that could not be suspended. Now it can be a 250.00 fine and be a probationary offense.
I ask again, who would benefit from a reduced penalty for making a false statement on an official California ID card application?

LEGISLATIVE COUNSEL'S DIGEST


AB 811, John A. Perez. Identification documents.
Existing law prohibits a check casher from charging a fee of more
than $10 to set up an initial account and issue an optional
identification card for providing check cashing services.
This bill would prohibit a check casher from selling any
identification card other than that optional check cashing
identification card. The bill would also prohibit a check casher from
requiring a customer to purchase a check cashing identification card
to access services or from misrepresenting the use of that
identification card. The bill would make related changes.
Existing law prohibits any person from manufacturing or selling an
identification document of a size and form substantially similar to
the identification cards or driver's licenses issued by the
Department of Motor Vehicles. Existing law provides that a violation
of that provision is a misdemeanor punishable by a fine of $1,000,
which shall not be suspended, and the person is required to perform
not less than 24 hours of community service during hours when the
person is not employed and is not attending school.
This bill would change the punishment for that crime to a fine
between $250 and $1,000, 24 hours of community service, and, in the
court's discretion, imprisonment in a county jail for not more than
one year. The bill would also provide that the court may place the
defendant on probation, with conditions that include, but are not
limited to, a fine and community service. The bill would provide that
no part of the fine or community service shall be suspended or
waived. Because this bill would change the penalty for an existing
crime, it would impose a state-mandated local program.
The California Constitution requires the state to reimburse local
agencies and school districts for certain costs mandated by the
state. Statutory provisions establish procedures for making that
reimbursement.
This bill would provide that no reimbursement is required by this
act for a specified reason.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. Section 1789.30 of the Civil Code is amended to read:
1789.30. (a) (1) Every check casher, as applicable to the
services provided, shall post a complete, detailed, and unambiguous
schedule of all fees for (A) cashing checks, drafts, money orders, or
other commercial paper serving the same purpose, (B) the sale or
issuance of money orders, and (C) the initial issuance of any
identification card for accessing check cashing services as described
in subdivision (b) of Section 1789.35. Each check casher shall also
post a list of valid identification which is acceptable in lieu of
identification provided by the check casher. The information required
by this section shall be clear, legible, and in letters not less
than one-half inch in height. The information shall be posted in a
conspicuous location in the unobstructed view of the public within
the check casher's premises.
(2) A check casher may be required to file a return required by
Section 18631.7 of the Revenue and Taxation Code.
(b) (1) Except as provided in paragraph (2), this section shall
become operative December 31, 2004.
(2) (A) Except as provided in subparagraph (B), paragraph (2) of
subdivision (a) shall apply to checks cashed on or after January 1,
2006.
(B) The amendments to this section made by the act adding this
subparagraph shall become operative on January 1, 2008.
SEC. 2. Section 1789.35 of the Civil Code is amended to read:
1789.35. (a) A check casher shall not charge a fee for cashing a
payroll check or government check in excess of 3 percent if
identification is provided by the customer, or 3.5 percent without
the provision of identification, of the face amount of the check, or
three dollars ($3), whichever is greater. Identification, for
purposes of this section, is limited to a California driver's
license, a California identification card, or a valid United States
military identification card. A check casher shall not sell any
identification card except as provided in subdivision (b).
(b) A check casher may charge a fee of no more than ten dollars
($10) to set up an initial account and issue an optional
identification card for providing check cashing services. A
replacement optional identification card may be issued at a cost not
to exceed five dollars ($5). A check casher shall not require a
customer to purchase a check cashing identification card to access
services, and it shall not misrepresent the use of that
identification card.
(c) A check casher shall provide a receipt to the customer for
each transaction.
(d) A check casher may charge a fee for cashing a personal check,
as posted pursuant to Section 1789.30, for immediate deposit in an
amount not to exceed 12 percent of the face value of the check.
(e) Any person who violates any provision of this section shall be
liable for a civil penalty not to exceed two thousand dollars
($2,000) for each violation, which shall be assessed and recovered in
a civil action brought in the name of the people of the State of
California by the Attorney General in any court of competent
jurisdiction. Any action brought pursuant to this subdivision shall
be commenced within four years of the date on which the act or
transaction upon which the action is based occurred.
(f) A willful violation of this section is a misdemeanor.
(g) Any person who is injured by any violation of this section may
bring an action for the recovery of damages, an equity proceeding to
restrain and enjoin those violations, or both. The amount awarded
may be up to three times the damages actually incurred, but in no
event less than the amount paid by the aggrieved consumer to a person
subject to this section. If the plaintiff prevails, the plaintiff
shall be awarded reasonable attorney's fees and costs. If a court
determines by clear and convincing evidence that a breach or
violation was willful, the court, in its discretion, may award
punitive damages in addition to the amounts set forth above.
(h) This section shall become operative December 31, 2004.
SEC. 3. Section 13004.1 of the Vehicle Code is amended to read:
13004.1. (a) No person shall manufacture or sell an
identification document of a size and form substantially similar to
the identification cards issued by the department.
(b) A violation of this section is a misdemeanor and shall be
punished as follows:
(1) The court shall impose a fine between two hundred fifty
dollars ($250) and one thousand dollars ($1,000), inclusive, and 24

for a crime or infraction, within the meaning of Section 17556 of the
Government Code, or changes the definition of a crime within the
meaning of Section 6 of Article XIII B of the California
Constitution.

An act to amend Section 20395 of the Public Contract Code,
relating to public contracts.


LEGISLATIVE COUNSEL'S DIGEST


AB 1409, as amended, John A. Perez. Public contracts: county
highways: work authorizations.
Existing law sets forth procedures pursuant to which work being
done by contract on county highways may be done. Existing law
specifies that in any county that has appointed a road commissioner,
or in any county that has abolished the office of road commissioner,
as prescribed, the board of supervisors of the county may authorize
the road commissioner, or a registered civil engineer under the
direction of the county director of transportation, to have any work
upon county highways done under his or her supervision and direction.
In this connection, existing law provides that the work on those
contracts may be done by: (1) letting a contract covering both work
and material, as provided; (2) purchasing the material and letting a
contract for the performance of the work, as provided; or (3)
purchasing the material and having the work done by day labor, in
which case advertising for bids is not required.
This bill would revise that provision authorizing the work on
those county highway contracts to be done by (1) purchasing the
material and having the work done by day labor, as defined,
only after advertising and requesting bids, as provided, and
the board passing a resolution making a specified finding; or (2)
purchasing the material and having the work done by day
labor for any work classified as maintenance work, as prescribed
specified employees, as defined .
Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. Section 20395 of the Public Contract Code is amended to
read:
20395. In any county that has appointed a road commissioner
pursuant to Section 2006 of the Streets and Highways Code, or in any
county that has abolished the office of road commissioner and
complied with Section 2006.1 of the Streets and Highways Code, the
board may authorize the road commissioner, or a registered civil
engineer under the direction of the county director of
transportation, to have any work upon county highways done under his
or her supervision and direction. The work may be done in any of the
following ways:
(a) By letting a contract covering both work and material. In that
event, the contract shall be let to the lowest responsible bidder as
provided in this article.
(b) By purchasing the material and letting a contract for the
performance of the work. In that event, the material shall be bought
at the lowest possible cost and the contract let to the lowest
responsible bidder as provided in this article.
(c) By purchasing the material and having the work done by day
labor, only after advertising and requesting bids as provided in this
article, and the board has passed a resolution making a finding that
either no bids were received or all of the bids received exceeded
the cost of having the work done by day labor. For purposes of
this subdivision, "day labor" means nonpermanent, part-time, or
temporary employees who are not represented by a collective
bargaining unit.
(d) By purchasing the material and having the work done by force
account. For purposes of this subdivision, force account means
full-time or permanent county employees, or part-time or temporary
employees who are represented by a collective bargaining unit.

(d)
(e) (1) By authorizing the county road commissioner or
a registered civil engineer under the direction of the county
director of transportation to execute changes for any contract
pursuant to this section in an amount not to exceed five thousand
dollars ($5,000) for contracts of fifty thousand dollars ($50,000) or
less, or 10 percent for contracts over fifty thousand dollars
($50,000) but not to exceed two hundred fifty thousand dollars
($250,000). In no event shall any change exceed a net total addition
of twenty-five thousand dollars ($25,000).
(2) For contracts whose original cost exceeds two hundred fifty
thousand dollars ($250,000), the extra cost for any change or
addition to the work so ordered shall not exceed twenty-five thousand
dollars ($25,000), plus 5 percent of the amount of the original
contract costs in excess of two hundred fifty thousand dollars
($250,000). In no event shall any change or alteration exceed one
hundred fifty thousand dollars ($150,000).
(e)
(f) By purchasing the material and letting a contract
for the work or by letting a contract covering both work and material
without advertising for bids when the estimated cost of emergency
work necessitated by the imminence or occurrence of a landslide,
flood, storm damage, or other emergency exceeds twenty-five thousand
dollars ($25,000) and the public interest and necessity demand
immediate action to safeguard life, health, or property.
(f) By purchasing the material and having the work done by day
labor for any work classified as maintenance work, which includes,
but is not limited to, work required to keep county roads open during
inclement weather.

Some place recently I read that Perez is Villarigosa's brother. Does anyone know if that is true?
