Fellow SOS'ers,

In a rare occurrence, a thread was deleted in the US Border Patrol RSS feeds section. The thread was in regards to a report of a man intercepted by Customs and Border Protection for a warrant issued by a Prince George County court relating to an assault related to a sexual crime. The subject of the warrant was arrested because he was a Kenyan citizen, and as a foreign national in the country lawfully, still deportable for crimes of this severity. The subject contacted us and provided evidence that his case was adjudicated and expunged, and the thread here was showing up on searches by prospective employers.
We conducted a search of the court records, and indeed the case has been expunged. No record exists of that case. The subject did however, provide a copy of his judgement that said he was found not guilty of either crime.

We thought it best to remove the post, if for no other reason than we had no evidence to support it, as the CBP website has also removed the posting from their website. This is a rare move by us, as we strongly support the 1st amendment, and the post was placed there under that concept. But having reviewed everything, the value of keeping the post up was outweighed by that favoring removal. In addition, this provides a teachable point about the judicial system, the immigration system, and how they work. The subject in question was, as mentioned before, a citizen of Kenya, here now as a lawful permanent resident. A background check has shown him to be a member of an organization that studies farming and ranching in arid regions. He's looking for work here now, obviously.

We have no idea what the circumstances were regarding his arrest, so we'll never no how he came to be the subject of the warrant. I do find it interesting that the jurisdiction chose to prosecute him, but then again, it wouldn't be the first time a person fell into the criminal justice system unjustly. For now though, we'll give him the benefit of the doubt, but watch this name for future reference.
