State Seeks to Make Justice Department Join Fight Over Immigration Law


With the Justice Department threatening to sue to block Indiana’s new immigration law, the state is beating the government to the punch.

Federal officials have already sued Arizona and Alabama over their immigration laws, and have said Indiana may follow. The state has asked a federal judge to add the Justice Department to the lawsuit already filed by the American Civil Liberties Union.

Judge Sarah Evans Barker agreed with the A-C-L-U and blocked enforcement of two provisions in June: a proposed ban on use of consular I-D cards, and a clause authorizing arrests based on immigration status. The case is awaiting a hearing on whether to make that order permanent.

Attorney General Greg Zoeller says it doesn’t make sense to argue the same issues twice, and says the government shouldn’t be allowed to effectively outsource its work to the A-C-L-U.

The law passed in April also strips companies of tax breaks if they knowingly hire illegal aliens, and makes illegals ineligible for in-state tuition.
