Man caught in immigration sting files lawsuit
Alleges federal authorities unfairly targeted him

A Latino man who was detained in a controversial 2007 law enforcement raid that swept up illegal immigrants at a 7-Eleven parking lot in Upper Fells Point is suing federal authorities, alleging he was mistreated and arrested without cause.
The suit was filed on behalf of just one person — 32-year-old Denis Alvarez of Southeast Baltimore — but an attorney with an immigrant advocacy group that crafted the suit said it is meant as an indictment against the raid in which two dozen men were arrested. The suit seeks a half-million dollars in damages.
The January raid at the store on Broadway angered and frightened Baltimore's Latino community, and members of Casa de Maryland accused federal immigration agents of racial profiling. A subsequent newspaper article reported that the raid's location and timing were designed to boost arrest stats for the Baltimore field office of U.S. Immigration and Customs Enforcement.

All this is another notice to Americans that our courts have been sabotaged to the point that an idiot suit of this kind can be filed. Oh yes how we tremble at the thought of having to appear before a judge repetitiously as our savings are decimated.

Yet an illegally present person can try to turn the tables on those arresting him with the help of saboteurs disguised as lawyers?

Government is inciting the law abiding citizen into Constitutionally backed actions that would include the arrest of those publicly elected and appointed "servants" that have sacrificed us all.

It's getting too late to play these games with the people of the USA but government will not stop unless it is stopped.

They just cannot help themselves.:mad::mad::mad:

Congress refuses to fund or compel enforcement of immigration law.

The Justice department, under the direction of the President Obama, sues Arizona for adopting federal immigration law as state legal code. ICE only seeks a certain type of illegal alien for deportation.

Immigration judges in Los Angeles deny 65% of the removal petitions brought before the court by ICE. The immigration court website lists contact information for pro bono immigration attorneys.

ICE attorneys have only something like 20 minutes to prepare for each removal case they present.

There needs to be an overhaul of the whole rotten system.

It may come to that.

Some of it has to do with numbers, as in some superior courts in California, the sheer amount of cases overwhelm the case load. For example, the Los Angeles County Metro traffic court on Hill Street is nine months behind on arraignment from the "due date", which I believe is normally both the arraignment and the trial date. I understand there has been a recent lay off at the court - and only something like 5% of people ticketed nationally challenge their tickets. Despite the fact that the court system is dependent on fines and assessments to survive and further considering that with the court being both judge and jury, if everyone contested their tickets it would bring the court system to it's knees. Not to mention that if the officer shows to act as witness / prosecutor he is paid at least four hours of overtime to do so. Takes all the profit out of the defacto ticket quota system built into traffic officer evaluation and promotion and officer productivity. The officer is in court on premium time rather than on patrol on straight time.

Likewise, the immigration court system isn't robust enough to handle the volume it is presented with. I don't know how the court is funded, but even the judges who are not predisposed to deny deportation are overworked as are ICE attorneys. Some of the "Latino advocate" organizations have been reported by the Spanish language media as being massively inundated with calls about how to fight deportation - I imagine that the "immigration hotline" to pro bono "abogado honesto" immigration attorneys are burning up the phones as well.

Perhaps the deportation denials are one way to reduce the caseload by pissed off judges, much as a traffic judge may rubber stamp a stack of Trial By Declaration cases as guilty without even looking at the cases, hoping that the defendant will miss the deadline for filing for Trial De Novo.

I have no idea if there is an appeals process for ICE to resort to, or if there are the resources or even the will to do so.

I think that is the magic quote right there. Seems no one in government or the legal system has any WILL.
