Me thinks this directly violates Wong Kim Ark vs. the USA. At least the article does not mention the case. An 'A' for effort but isn't this an 'F' for jurisdiction, i.e., established federal precedent for over 100 years?

The issue might boil down to whether the states can be forced to issue birth certificates to classes of people.
