Del Rio, Texas –The Texas Attorney General’s Office along with local, state, and federal law enforcement agencies have started the “Taking Care of Business” initiative. The program is a pro-active law enforcement effort that will reduce criminal activity in and around local businesses and properties by using exiting law under the "Texas State Nuisance Abatement Statutes." This does not replace conventional methods of law enforcement but supplements efforts by providing additional tools to combat illegal activity.
The first step of this initiative is an educational outreach to local business and property owners, providing insight into identifying and deterring criminal activity. Some of the illegal activities that the statutes address are prostitution, obscenity, gambling, organized criminal activity, discharge of firearms, alcohol violations; and delivery, possession, manufacture or use of a controlled substance.
Properties that meet nuisance abatement criteria, and are being exploited by criminal elements as bases of operations, will be targeted.
The purpose of a nuisance abatement lawsuit is not to allege property owners are guilty of illegal acts, but rather to prove that they allowed the illegal activity to occur on the property and failed to make reasonable attempts to stop it.
Supervisory Border Patrol Agent Brandon Spencer notes "Denying the use of real property for criminal activity will create a safer community."
